PREMIUM CONTENT PLATFORM SELLER AGREEMENT FOR COMMERCIAL USE AND PERSONAL USE WITH NON-EXCLUSIVE EXTENDED LICENSE

This Agreement controls the licensing relationship between the Seller and the Buyer of Content made available on the Premium Content Platform of ViaStock.pl

This License is for personal and commercial uses as defined in this Agreement.

Buyer and Seller acknowledge that this Agreement is made subject to the Terms and Conditions for the Premium Content Platform. The creator on ViaStock.pl who made files available on the Premium Content Platform (the "Platform") is the "Seller" and the member of ViaStock.pl who obtains a download of the files through the Platform is the "Buyer." The file or files made available by the Seller for download and the various elements of the content in those files are referred to as the "Content." The act of obtaining the file(s) from the Platform is referred to as the "Download."

The Content is the original work of the Seller and/or Seller has all rights necessary to license the Content to Buyer as indicated in this Agreement. All of the licensed content is owned by either ViaStock or the artists who supply the content so no other person or company has any right to control the Content.

Seller grants to Buyer a non-exclusive, perpetual and extended license to use the Content as follows:

• Commercial use:

1. In any manner permitted, without any limitation on the number of reproductions, impressions, or budget.
2. For resale only if licensed image is part of the product.
3. Using in products like: cards, stationery items, paper products, calendars, apparel items, posters (printed on paper, canvas, or any other media), DVDs, mobile applications, postcards, mugs, t-shirts, posters, website templates, business card templates, electronic greeting card templates, brochure design templates). and other items.
4. Materials included in many advertising campaigns, marketing and promotional materials like: print, video, TV, social media, blog, website etc.

• Also personal use:

1. Private webpage, social media (such as an avatar, skins, themes and backgrounds), the right to use the content on any number of webpages personal to the Buyer or as a personal identifier for the Buyer on the Web or within a online environment such as a game or X-box Live;
2. If the Content is of a type for use in the customization of a personal electronic device (such as "wallpaper," screensavers, skins, sound effects, visual themes, avatars), the right to use the content on any number personal devices belonging to the Buyer.

License for a single file is assigned to the name and surname only of the one registered user on ViaStock or registered under only one business name.

Anyone other than the Licensee called a buyer on ViaStock.pl doesn't have permission to customize a digital or physical End Product for commercial or non-commercial use.

A separate license is required for each social media business account, each business under different names.

• You don't have permission to:

1. Resale and sale original image/file.
2. Resale and sale license to original image/file.
3. Sharing oryginal files for downloading on other sites/platforms for free or for money.
4. Claim the Licensed Asset itself as its own copyrighted work if you aren't the owner of the files and registered as a creator on ViaStock.

• You have permission to:

1. share links from our site ViaStock.pl with watermarked previews.

Seller retains and reserves all other rights to the Content under copyright, trademark or other intellectual or commercial laws and the Buyer acknowledges that Seller is the owner of the Content. Seller warrants and represents to the Buyer that Seller is the true owner of the Content and that there will be no interference by any third party making any other claim of ownership of the Content.

Buyer may not sub-license or assign any rights acquired under this Agreement. Buyer may never resell any file obtained with the Download

Buyer agree that by using this Agreement form and by acknowledging its use on the Premium Content Platform at the time of the Download the transaction record for the Download will be the equivalent of their respective electronic.
